1. Acceptance of Terms

By accessing or using this website ("Website") or any mobile application developed by SBT Photography, LLC ("SBT Photography," "we," "us," or "our"), you ("User," "you," or "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree with these Terms, please do not use our Website or applications.

2. Description of Service

We develop and operate mobile applications that allow users to schedule personal events and configure automated notifications, including optional SMS notifications to designated trusted contacts. The specific functionality of each application is described within the application itself.

3. Eligibility

You must be at least 18 years of age to create an account or use our applications. By using our applications, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.

4. User Accounts

To use certain features of our applications, you may be required to create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

5. Trusted Contacts and Consent

If you choose to designate a trusted contact within our applications, you represent and warrant that:

- You have obtained that individual's permission to share their contact information with us.
- You will not add any individual as a trusted contact without their knowledge and consent.
- The trusted contact understands they may receive SMS messages from our service and may opt out at any time by replying STOP.

You acknowledge that any individual added as a trusted contact retains the right to opt out of SMS communications at any time, and we will honor such opt-outs immediately.

6. SMS Messaging Terms

By using our SMS notification features, you and any designated trusted contact agree to the following:

- **Consent:** trusted contacts must affirmatively opt in by replying YES to the initial consent-confirmation message before receiving further SMS notifications.
- **Opt-out:** trusted contacts may opt out at any time by replying STOP. Replying HELP returns a brief description of the service and contact information.
- **Frequency:** message frequency depends on user activity within the application. There is no marketing or recurring promotional messaging.
- **Charges:** standard message and data rates from the recipient's mobile carrier may apply. SBT Photography, LLC does not charge for SMS messages.
- **Carrier support:** SMS service is supported on major U.S. mobile carriers. We are not liable for delays, failures, or carrier-specific issues that may affect SMS delivery.

7. Acceptable Use

You agree not to:

- Use our applications for any unlawful purpose or in violation of any applicable laws.
- Add individuals as trusted contacts without their consent.
- Use the application to harass, stalk, intimidate, or threaten any person.
- Attempt to interfere with, compromise, or disrupt the security or functionality of our applications.
- Reverse-engineer, decompile, or attempt to extract source code from our applications.
- Use our applications to send spam or unsolicited commercial messages.

We reserve the right to suspend or terminate accounts that violate these acceptable-use restrictions.

8. Intellectual Property

All content, software, design, and other materials related to our applications and Website are the property of SBT Photography, LLC or our licensors and are protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use our applications for your personal, non-commercial use, subject to these Terms.

9. Disclaimers

OUR APPLICATIONS AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

WE DO NOT WARRANT THAT OUR APPLICATIONS WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. SMS DELIVERY DEPENDS ON THIRD-PARTY MOBILE CARRIERS AND IS SUBJECT TO THEIR LIMITATIONS, OUTAGES, AND DELAYS.

OUR APPLICATIONS ARE NOT DESIGNED FOR EMERGENCY USE. DO NOT RELY ON OUR APPLICATIONS AS A SUBSTITUTE FOR EMERGENCY SERVICES. IN AN EMERGENCY, CALL 911 OR YOUR LOCAL EMERGENCY SERVICES NUMBER.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL SBT PHOTOGRAPHY, LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OUR APPLICATIONS OR WEBSITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF OUR APPLICATIONS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED DOLLARS ($100).

11. Indemnification

You agree to indemnify, defend, and hold harmless SBT Photography, LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your use of our applications, your violation of these Terms, or your violation of any rights of another party.

12. Termination

We may suspend or terminate your access to our applications at any time, with or without cause, with or without notice. Upon termination, your right to use our applications will cease immediately. Provisions of these Terms that by their nature should survive termination will continue to apply.

You may delete your account at any time by following the instructions within the application or by contacting Support@sbtphotos.com.

13. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law provisions. Any legal action arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located in Howard County, Texas, and you consent to the personal jurisdiction of such courts.

14. Changes to These Terms

We may modify these Terms from time to time. When we do, we will update the "Effective date" at the top of this page. Material changes will be communicated through the application or by email when possible. Your continued use of our applications after the effective date of any changes constitutes your acceptance of the modified Terms.
